Attention: All Companies Using IgniteUps.Ai

By using IgniteUps.Ai, including but not limited to its TCPA and DNC verification services, you acknowledge and agree that your company remains fully responsible for compliance with all applicable Telephone Consumer Protection Act (TCPA) and Do Not Call (DNC) Registry regulations.

Your Compliance Obligations

1. TCPA Compliance:

• The TCPA restricts telemarketing calls, text messages, and the use of automated dialing systems (ATDS) or prerecorded voice messages to consumers without their express written consent.
• You must ensure that all calls and messages comply with the consent requirements outlined in 47 U.S.C. § 227 and relevant FCC regulations.
• Failure to comply with TCPA regulations may result in fines of up to $1,500 per violation and potential class-action litigation.

2. Do Not Call (DNC) Registry Compliance:

• Companies engaged in telemarketing must maintain and adhere to an internal Do Not Call list and ensure they do not contact consumers who have opted out of marketing communications.
• The National Do Not Call Registry applies to all unsolicited sales calls. Violations can result in fines of up to $50,120 per call per FTC regulations.
• You are required to maintain accurate records of opt-outs and provide a clear mechanism for consumers to withdraw their consent.

Indemnification and Release of Liability

By utilizing IgniteUps.Ai's services, including but not limited to TCPA and DNC verification, you acknowledge and agree that:

• Your company remains solely responsible for compliance with all TCPA and DNC regulations, regardless of any verification services provided by IgniteUps.Ai.
• IgniteUps.Ai makes no guarantees, warranties, or representations regarding your company's compliance with federal or state telemarketing laws.
• You fully indemnify, release, and hold harmless IgniteUps.Ai, its affiliates, officers, employees, and agents from any and all claims, liabilities, damages, losses, penalties, fines, legal fees, or other costs arising from or related to your company's telemarketing practices, including but not limited to violations of TCPA or DNC regulations.
• Your company assumes all legal and financial liability for any non-compliance, whether due to your actions, your agents, or third-party providers acting on your behalf.

We strongly advise consulting with legal counsel or a compliance expert to ensure that your business follows all applicable federal and state telemarketing laws.
